Order on Motion to Continue Order on Motion for Preliminary Injunction
ORDER: Considering Plaintiff's Motion to Continue Hearing on Motion for Preliminary Injunction (Doc. 40) ("MTC") and Motion for Preliminary Injunction (Doc. 4) ("MPI"), IT IS ORDERED that the MPI (Doc. 4) is DENIED WITHOUT PREJUDICE to Plaintiff's right to refile after further discovery, if it can do so in good faith. IT IS FURTHER ORDERED that the parties should confer further in a good faith effort to resolve any discovery disputes; if they are unable to resolve same, they should move for a conference with the Magistrate Judge for resolution. IT IS FURTHER ORDERED that, if the August 20, 2026, settlement conference is unsuccessful (Doc. 36), the parties shall move for a scheduling conference with the Magistrate Judge to set pretrial deadlines and a trial date at the earliest available setting, taking into account the need for discovery and motion practice.
