Order on Motion for Leave to File Document Under Seal
TEXT ORDER: Sig Sauer 120 moves to file under seal its 119 response to Springfield's counterclaims. For its part, Sig Sauer correctly recognizes that Civil Local Rule 5.10 demands that parties explain "how the document meets the legal standards for filing sealed documents." And it invokes Fed. R. Civ. P. 26(c)(1)(G) to meet that demand. But Rule 26(c) is inapposite. That Rule empowers courts to issue protective orders when one party seeks discovery from another; it does not establish a legal standard for concealing that information from public view. Indeed, the latter is far more exacting: "Documents that affect the disposition of federal litigation are presumptively open to public view, even if the litigants strongly prefer secrecy, unless a statute, rule, or privilege justifies confidentiality." In re Specht, 622 F.3d 697, 701 (7th Cir. 2010). What's more, it appears the very information Sig Sauer asks to seal is "vital" to the resolution of Springfield's inequitable conduct defense. Baxter Int'l, Inc. v. Abbot Laby's, 297 F.3d 544, 545 (7th Cir. 2002). Finally, Sig Sauer explains that the information in question was designated "attorneys' eyes only." But Judge Hanna's standing order expressly states that "parties cannot agree to file documents under seal that otherwise do not meet the legal standards for" doing so. Hon. Ronald L. Accordingly, Sig Sauer may renew its 120 motion to seal, so long as it addresses these concerns. Until then, Document 119 will provisionally remain under seal pending the Court's disposition of Sig Sauer's renewed motion to seal, which should be filed no later than June 26, 2026. Should Sig Sauer opt not to renew its motion, Document 119 will automatically be unsealed, and Sig Sauer ordered to publicly file an unredacted version of its 118 answer.
