Order on Motion for Order
Magistrate Judge Christopher L. Morgan: ELECTRONIC ORDER denying, without prejudice, 19 Defendant Steve Aiudi's Motion for Order of Compliance. Pursuant to Federal Rule of Civil Procedure 37(a)(1), a party seeking "an order compelling disclosure or discover... must include a certification that the movant has in good faith conferred or attempted to confer with the person or party failing to make disclosure or discovery in an effort to obtain it without court action." Similarly, Local Rule 7.1(a)(2) provides that "[n]o motion shall be filed unless counsel certify that they have conferred and have attempted in good faith to resolve or narrow the issue." Defendant Aiudi's motion fails to include the required certification stating he conferred or attempted to confer with the plaintiff prior to filing. The motion is therefore denied without prejudice to Defendant Aiudi's right to refile a motion that complies with the requirements of Fed. R. Civ. P. Rule 37(a)(1) and Local Rule 7.1(a)(2). (MPZ)
