TEXT ORDER: The Court has reviewed Defendants' August 20, 2026 letter [D.E. 114], which raises concerns about the prospect of litigating overlapping post-2023 claims concerning the MSSB cash-sweep program in this matter and in Estate of Bernard Sherlip v. Morgan Stanley, No. 24-4571 (S.D.N.Y.). The Court also has reviewed Interim Class Counsel's August 21, 2026 response [D.E. 115]. Defendants seek to brief the "duplication" issue before this Court. It does appear from the Consolidated Amended Complaint (CAC) that there might be an overlap between the claims in the CAC and in Sherlip. The putative class in the CAC now includes E*Trade customers with cash deposits in the E*Trade or MSSB cash-sweep programs from February 1, 2018 to the present, while in Sherlip the putative class includes claims arising from MSSB's cash-sweep program for the period of October 17, 2018 to the end of the alleged conduct, and therefore includes the same post-2023 timeframe. The question is whether this issue is better resolved in this litigation as Defendants suggest, or before Judge Caproni in Sherlip, as Plaintiffs suggest. The parties are directed to continue to meet and confer on this issue, and submit an updated, joint status letter by September 17, 2026. The status conference will proceed as scheduled on September 24, 2026. The deadlines set forth in the July 24, 2026 Order [D.E. 105] remain in effect.. So Ordered by Magistrate Judge Michael A.
