   Minute Entry and Order: An Initial Conference was held via video on 7/30/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Bruce Akerly and Stuart Kossar for Plaintiff; Seth Pavsner for Defendants. Discussion held regarding case status, Defendants' pending motion to dismiss, and what discovery is proportional in light of the pending motion. The parties agreed to commence limited discovery at this time. As stated on the record, first requests for documents and interrogatories shall be exchanged by 9/15/2026. Responses to the first requests for documents and interrogatories shall be exchanged by 10/16/2026. Given the scope of the pending motion to dismiss, the Court declined to set a deadline for initial disclosures as the scope of the case could be significantly impacted by the pending motion.

   The parties are directed to file a joint status report by 10/30/2026, including an update as to case status and their progress on discovery, and proposing additional discovery steps or the parties' respective positions on further discovery. The parties are respectfully reminded that they may also suggest a full discovery schedule and may use the Court's Case Management Worksheet, available on the Court's website.
