Order on Motion to Stay
ORDER: On July 14, 2026, the parties filed a Joint Motion requesting the Court "stay all deadlines in this matter, including the deadlines set forth in the Court's [Early Neutral Evaluation Conference ('ENE')] Order (ECF No. 11), for ninety (90) days... [because] [t]he Parties are in the process of scheduling a mediation, which is expected to occur within the ninety-day stay period." ECF No. 14 at 2. The Court DENIES the Joint Motion without prejudice because the parties have not yet scheduled a private mediation and, therefore, have not set forth good cause to continue all Court hearings and deadlines for 90 days.
The July 27, 2026 pre-ENE Status Conference is continued to September 8, 2026, at 11 a.m. The July 29, 2026 ENE and Case Management Conference ("CMC") are continued to September 9, 2026, at 1:30 p.m. Counsel must meet and confer pursuant to Fed. R. Civ. P. 26(f) no later than August 19, 2026. The deadline to exchange Rule 26(a)(1)(A-D) initial disclosures, lodge confidential briefs, including ENE participant names and attorney contact information, and file the Joint Discovery Plan is September 2, 2026. Signed by Magistrate Judge Michael S. Berg on 7/15/2026. (no document attached) (kxb)
