[53-1]), the Order 48 granting 36 Plaintiff's Motion for Summary Judgment and denying 40 Defendant's Motion for Summary Judgment is VACATED. It is further ordered that summary judgment is entered in favor of Defendant Energy Harbor Nuclear Corporation and against Plaintiff International Brotherhood of Electrical Workers, Local Union 29, AFL-CIO for the reasons set forth more fully in the Court of Appeals' Opinion.
