ORDER GRANTING JOINT STIPULATION TO STAY PENDING MEDIATION 22 by Judge Otis D. Wright, II: 1) This matter is STAYED pending completion of mediation. 2) The parties shall notify this Court within forty-five (45) days of this Order with the name of the mediator and the date selected for mediation.3) The parties shall file with this Court within seven (7) days of mediation a status report providing the outcome of mediation. 4) In the event that the parties fail to timely engage in mediation, or the matter fails to resolve through mediation:a. Plaintiffs individual wage claims and individual PAGA claims shall be submitted to arbitration in accordance with the provisions of the Arbitration Agreement; b. Plaintiffs putative class claims shall be dismissed without prejudice as to any other putative class member; c. Upon dismissal of Plaintiff's putative class claims, the matter, including Plaintiff's Representative PAGA claims, shall be remanded to state Court; d. Upon remand, this matter, including Plaintiffs representative PAGA claims, shall be stayed pending completion of Plaintiffs individual arbitration. 5) The Court DENIES AS MOOT Defendants' Motion to Compel Arbitration 14 . 6) The Court VACATES all other dates and deadlines.
