Status Conference Order on Motion
MINUTES of Proceedings: Telephonic conference held. The parties were heard on the Motion to Exclude Expert Witnesses, ECF 201 . Discovery is reopened for the limited purpose of completing the outstanding expert witness depositions. Pursuant to Federal Rule of Civil Procedure 37(b)(2), the outstanding expert witnesses shall be made available for deposition at plaintiff's cost. Defendant shall determine whether depositions are conducted in person, by telephone, or other means. In light of the depositions, the trial currently set to begin on June 18, 2024 and the pretrial conference currently set for May 30, 2024 are continued. The parties are directed to confer and propose new trial and pretrial conference dates by May 10, 2024. Because the trial is continued to accommodate the outstanding depositions, the Motion to Exclude Expert Witnesses, ECF 201 , is denied as moot. Lin Thunder present as counsel for plaintiff. ***Set Deadline: The parties recently informed the Courtroom Deputy by email that they have reached an agreement to resolve this case. Pursuant to the parties' notice and Section III of this Court's Standing Order for All Civil Cases, counsel shall file a stipulation of dismissal no later than 6/7/2024. If the parties do not submit a stipulated dismissal by that deadline, the Court will enter its standard order of post-settlement dismissal. Should additional time be needed, counsel must contact the Courtroom Deputy to request an extension of this deadline. (NAW)
