Magistrate Judge motion hearing held (by video) on 5/7/2024 regarding Plaintiffs' Motion to Compel Production of Information regarding Legacy Electronic Systems from the L'Oreal group of defendants [537, 538]. Only counsel for Plaintiffs and the L'Oreal defendants ((L'Oreal USA, Inc., L'Oreal USA Products, Inc. and Softsheen-Carson LLC) were requested to appear. By agreement, L'Oreal defendants will provide supplemental responses to Interrogatories Nos. 3 through 5, 7, 11, 12 through 14, 20, 22, and 23 by 5/24/2024. The parties are then to confer over the sufficiency of the responses. If disputes remain, these are to be summarized in the JSR that all parties are filing on 6/3/2024 related to legacy system discovery. As for L'Oreal responses to Interrogatories Nos. 6, 8-10, 15-18, 21, and 25 (described in L'Oreal USA's brief regarding legacy systems [535-1]), Plaintiffs report that these are not in dispute. The parties report that they are at impasse on the issue of whether L'Oreal USA must collect custodian files from L'Oreal S.A. (a foreign entity not yet served) and this requires briefing. The Court adopts the parties' proposed briefing schedule as follows: Plaintiffs' motion to compel to be filed by 6/7/2024. L'Oreal's response is due by 6/28/2024. MINUTE entry before the Honorable Sheila M. Finnegan. Magistrate Judge status hearing held (by video) on 5/7/2024. Three topics were addressed. This order relates to the Special Master topic. For the reasons stated on the record, the Court overrules Defendants' objections to the appointment of Professor Maura Grossman, and appoints her to serve as Special Master for ESI discovery until further order of this Court. After consideration of Professor Grossman's declarations dated 3/11/2024 and 3/25/2024, as well as the information provided by Defendants in various filings and during hearings, the Court finds that no ground for disqualification exists under Federal Rule of Civil Procedure 53(a)(2). Nonetheless, because Professor Grossman recently worked with certain Paul Weiss attorneys (not those appearing in this matter) in an unrelated lawsuit in which she submitted a declaration in support of a TAR protocol, the Court will allow the Paul Weiss attorneys representing Revlon to request that the Court resolve any TAR-related disputes between Revlon and Plaintiffs rather than referring them to the Special Master. It does not appear, however, that Revlon intends to use TAR as a search methodology, and Professor Grossman has ended her work with Paul Weiss in the unrelated matter in any event. By 5/21/2024, the parties are to submit a proposed Special Master appointment order to the Court. To facilitate this, the draft version is to be circulated to other counsel by 5/14/2024.
