Order Dismissing Case
TEXT ORDER denying 246 Plaintiff's motion for the reasons stated by Defendants in their opposition (Dkt. No. 246 ), and the Court's Text Order of 05/02/2023 (Dkt. No. 223), and directing that this case be STATISTICALLY CLOSED until such a time as (1) Plaintiff is released from prison, (2) he can pay the costs of his physical product for trial, or (3) he can pay the costs of the contemporaneous transmission of his trial testimony from his correctional facility. At that time, Plaintiff may file a letter with the Court requesting to reopen this action. IT IS HEREBY ORDERED that the Clerk of the Court shall submit a JS-6 (using Statistical Code 18) to the Administrative Office of the U.S. Courts. The parties are advised that nothing contained in this Text Order shall be considered a dismissal or disposition of the above-entitled action, and that, should further proceedings in it become necessary or desirable, any party may reopen the action by advising the Court in writing that additional relief is needed.
