Minute Order Order on Motion for Protective Order
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 9/4/2026.
The Court has before it Defendant Advanced Lodging Concepts, Inc.'s Emergency Motion for Protective Order Regarding Improperly Noticed Deposition. ECF No. 91. The Court reviewed the Motion but has no way to resolve the issues presented before the three depositions set for Labor Day would take place. One of the three depositions is of ALC's 30(b)(6) that included 37 topics. The two other depositions are of experts. It is unimaginable how these three deposition could be completed in a single day--let only after short notice on a federal holiday.
Accordingly, IT IS HEREBY ORDERED that the depositions set for Labor Day are vacated.
IT IS FURTHER ORDERED that if Jetco's pending request to extend discovery is granted, the Court will provide time to take all three depositions. However, if no extension of discovery is ordered, the Court, to ensure fundamental fairness given Jetco's lack of an opportunity to respond, as well as to promote a decision on the merits, will provide Jetco the opportunity to take ALC's 30(b)(6) deposition, topics to be determined at a later date.
IT IS FURTHER ORDERED that, based on the foregoing, Defendant Advanced Lodging Concepts, Inc.'s Emergency Motion for Protective Order Regarding Improperly Noticed Deposition (ECF No. 91 ) is GRANTED in part and DENIED in part consistent with the content of this Order.
