Order 1 - Terminate Hearings
Magistrate Judge Jennifer C. Boal: ELECTRONIC ORDER entered. On July 8, 2026, a discovery hearing was set for July 23, 2026, to resolve issues regarding a TAR protocol (Docket No. 239 ), a deposition protocol (Docket No. 240 ), and an ESI protocol (Docket No. 244 ). Docket No. 252 . Since then, the parties have agreed on a TAR protocol. See Docket No. 260 . As to the two remaining protocols, this Court rules as follows: (1) it adopts the Defendants' proposed deposition protocol at Docket No. 240 -2, and (2) it adopts the Plaintiffs' proposed ESI and paper documents protocol at Docket No. 244 -1 with the modification that privilege logs shall be produced on a rolling basis, no later than forty-five (45) days after the production of documents containing material for which one or more privileges or protections are asserted. Plaintiffs shall file a revised ESI protocol consistent with this Court's ruling by Friday, July 24, 2026. The hearing scheduled for Thursday, July 23, 2026, is cancelled. (JL)
