Order on Motion for Default Judgment
ORDER STRIKING 9 Motion for Default Judgment -- Plaintiff's motion for default judgment is STRICKEN as deficient. Clearly, Plaintiff has failed to familiarize itself with the Court's Individual Rules, which require that previously filed documents be referred to by their docket entry numbers and NOT attached as exhibits. See, Judge Irizarry's Individual Rules and Practices ("Individual Rules"), Section IV(D). Plaintiff also failed to file a memorandum of law in support of the motion, submitting only a notice of motion, affidavit, proposed judgment, a copy of the certificate of default and a copy of the proposed order. Id. at Section IV(E); Local Rule 7.1(a)(2). Plaintiff is granted leave to file a proper default judgment motion BY NO LATER THAN MAY 28, 2024 and is directed to serve a copy of this Electronic Order on Defendant, which has not appeared in this action, BY NO LATER THAN MAY 21, 2024 and immediately thereafter file proof of such service with the Court. Plaintiff is reminded that it has a standing obligation to serve Defendant with all filings. SO ORDERED by Judge Dora Lizette Irizarry on 5/15/2024. (CC)
