Scheduling Order
ORDER: Plaintiffs' counsel states that he will waive investigative costs and "remit" those costs to each plaintiff, such that each plaintiff will receive an additional $300.00 as part of their settlement payment. ECF No. 18 . As noted in my last Order, however, it is not within the Court's discretion to rewrite terms of a settlement agreement filed for the Court's approval. "When presented with a settlement for approval, a district court's options are to (1) accept the proposed settlement; (2) reject the proposed settlement and delay proceedings to see if a different settlement can be achieved; or (3) proceed with litigation." Fisher v. SD Protection Inc., 948 F.3d 593, 606 (citation omitted). While the Court appreciates counsel's good faith offer to remit investigative costs to his clients, this proposed modification to the settlement agreement must be filed by the parties.
Accordingly, the parties shall jointly file an amended settlement agreement by May 23, 2024. Ordered by Magistrate Judge Lois Bloom on 5/16/2024. (EW)
