ENDORSED ORDER re: 275 Defendant Safeco [Insurance Company of] America's Supplemental Motion on Amount of Attorneys' Fees and Costs. For the reasons stated on the record at the May 16, 2024, hearing on the matter, including the questions and issues raised by the Court, Defendant's motion is denied without prejudice. To the extent Defendant wishes to renew its request for fees and costs, no later than June 27, 2024, it shall first confer in good faith--either in person or via videoconference--with Plaintiff Endurance American Specialty Insurance Company regarding the relief Defendant seeks. If the parties are unable to reach an agreement, Defendant shall file an amended fee and costs motion no later than July 22, 2024, and Plaintiff shall file its response to same no later than September 6, 2024. The parties shall ensure that their respective submissions fully address the concerns raised by the Court at the May 16 proceeding. Nothing in this Order shall be construed as a ruling by the Court on the procedural or substantive propriety of Defendant's original motion (275). Signed by Magistrate Judge Christopher P.
