ENDORSED LETTER addressed to Mr. Troia and Mr. Toossifrom Naomi Reice Buchwald United States District Judge dated 7/10/2026 re: LoanStreet Inc. et al. v. Troia. ENDORSEMENT: The Court is in receipt of the parties' submissions of May 12, May 27, and June 3, 2026, ECF Nos. 229, 271, 278, addressing Mr. Troia's request to remove the "Confidential" designation from six documents. The six challenged documents, LS-0001392, LS-0001394, LS-0001448, LS-0001449, LS-0001450, and LS-0001451, consist of internal records of LoanStreet containing personnel payroll information, as well as expenditure information, that is presumptively confidential. If Mr. Troia contends that there is a specific, articulable reason to deviate from the presumptive confidential treatment of any of these documents, he shall explain that basis with specificity as to each document. The Court further acknowledges that four of the challenged documents appear on Mr. Troia's proposed trial exhibit list, and one of the challenged documents appears on plaintiffs' proposed trial exhibit list. However, the inclusion of a document on a proposed exhibit list does not by itself warrant remove of its "Confidential designation. Mr. Troia must identify, with respect to each document, the specific basis on which he contends that de-designation is appropriate and why that document would be admissible at trial, i.e., relevant to a material issue and not otherwise excluded by Federal Rule of Evidence 403.
