Order on Motion for Reconsideration
ORDER denying 337 MOTION for Reconsideration. Plaintiff moves for reconsideration essentially seeking additional time to file objections pursuant to Fed. R. Civ. P. 72. A motion for reconsideration requires the movant to show (1) an intervening change in controlling law; (2) the availability of new evidence; or (3) the need to correct clear error or prevent manifest injustice. D. Kan. Rule 7.3. The Court granted in part Plaintiff's prior motion for reconsideration and, consistent with Rule 72, ordered that any objections to the Court's order be entered no later than May 10, 2024, which was 14 days after the entry of the Court's original order entered on 4/26/24. Plaintiff was afforded 14 days to file an objection; therefore, he has not established a need to correct clear error or prevent manifest injustice. Plaintiff is also reminded that his deadline to conduct a 30(b)(6) deposition is June 14, 2024 and that deadline will not be further extended by the Court. Signed by Magistrate Judge Brooks G. Severson on 5/13/2024. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) (tl)
