Dismiss Case Amend/Correct
MINUTES (IN CHAMBERS) by Judge Otis D. Wright, II: On May 6, 2024, Plaintiff filed a Request for Leave to Amend Complaint. On May 8, 2024, Defendant Angel Mendoza filed a Motion to Dismiss Plaintiff's Complaint. The Court GRANTS pro se Plaintiff's Request to Amend Complaint 12 . Plaintiff has until June 6, 2024, to file an amended complaint. As such, Defendants' Motion to Dismiss 10 is hereby DENIED AS MOOT. Plaintiff is advised that the Federal Pro Se Clinic offers free information and guidance to individuals who are representing themselves in federal civil actions (see document for Pro Se Clinic information herein). MINUTES (IN CHAMBERS) by Judge Otis D. Wright, II: On May 13, 2024, Plaintiff Elizabeth Thomas requested an Ex Parte hearing to remove an involuntary hold on Plaintiff Ezekiel Lee Harris 15 . In Mission Power Eng'g Co. v. Cont'l Cas. Co., the court provided the requirements a party must meet in order to obtain ex parte relief (SEE DOCUMENT FOR SPECIFICS). Plaintiff Thomas failed to address Mission Power in her application. Additionally, the ex parte application does not include key details regarding the circumstances of the involuntary hold. These details are necessary for the Court to make a determination on thenature of the request. Furthermore, the actions of state court do not bear any weight in Federal court. Accordingly, Plaintiff Thomas's Request for an Ex Parte hearing is DENIED. (lc)
