In these two qui tam cases, the parties have resolved all claims except for a retaliation claim advanced by relator Charles Birchall against certain defendants. (The Court understands there are also some separate issues regarding fees and payment amounts between the relators and the government).
Rather than commencing discovery on the retaliation claim, the defendants request the Court stay discovery pending the resolution of criminal proceedings which arose out of the qui tam cases. Doc No. 170 in 15cv12877; Doc. No. 137 in 15cv12908. The criminal proceedings are pending before Judge Talwani, who has established a firm trial date of October 7, 2024. Doc. No. 167 in 21cr10256.
After carefully reviewing the papers and considering the arguments presented at the motion hearing, in light of the potential complexity of the Fifth Amendment issues posed by commencing discovery now, as well as the relatively short delay to permit the criminal trial to conclude first, the Court ALLOWS the Motions to Stay Proceedings.
The Court further ORDERS that the parties shall file a joint status report setting forth their joint or separate positions as to how the Court should proceed with the qui tam cases at the earlier of (1) the resolution of the criminal proceedings now pending before Judge Talwani; or (2) November 14, 2024.
