The Court has reviewed the motion to dismiss (ECF No. 6 ,) the complaint (ECF No. 1 ,) the response (ECF No. 11 ) and the reply (ECF No. 20 .) Mr. Little and Mr. Campbell present argument. The Court makes findings for the record and advises the parties that the Court will issue an oral ruling. For the reasons the Court has placed on the record, Defendant's motion to dismiss (ECF No. 6 ) is granted, without prejudice, as to the RICO claim. The Court declines to exercise supplemental jurisdiction over the other claims. Plaintiff is given leave to amend the RICO claims within 15 days. Failure to file an amended complaint within 15 days will result in the dismissal of this action with prejudice.
