MEMO ENDORSEMENT on re: 40 Letter, filed by New York Hotel and Motel Trades Council, AFL-CIO. ENDORSEMENT: It is HEREBY ORDERED that briefing for Plaintiff's motion for preliminary injunction (the "PI Motion") shall proceed as follows. Defendants' oppositions and cross-motions to the PI Motion shall be due jointly on June 6, 2024 (Defendant may, as requested, cross-move to confirm the arbitration award at this time, if they choose); Plaintiff's reply in further support of the PI Motion shall be due June 27, 2024; Plaintiff's opposition to any cross-motions by Defendants shall be due July 11, 2024; and Defendants' replies in further support of any cross-motions shall be due July 25, 2024. It is FURTHER ORDERED that a hearing on the PI Motion will be held on Thursday, September 5, 2024 at 9:30a.m. in Courtroom 906 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, New York 10007. By no later than August 22, 2024, counsel for all parties are directed to submit a joint letter to the Court proposing the amount of time each party seeks for presentation and argument, and informing the Court as to whether any party seeks to present evidence not submitted as part of the motion papers at the hearing and the nature of that evidence (i.e., demonstratives, witness testimony, etc.). Finally, given the report from the parties that the arbitration has now concluded, any future deadline for the parties to submit status reports as set forth in the April 22, 2023 Order at Dkt. Before the Court is the Motion for Withdrawal of Counsel. ECF No. 676 . Counsel for Plaintiff seeks to withdraw attorneys Casey R. Fronk and Michael E. Welsh as counsel of record in this case. Plaintiff will continue to be represented by Douglas M. Miller and Marc D. Katz of the U.S. Securities and Exchange Commission. Id. at 2. Thus, Plaintiff's Motion is not to withdraw, but to remove Ms. Fronk and Mr. Welsh from the list of counsel for Plaintiff and from the electronic service system.
Accordingly, IT IS HEREBY ORDERED that the mistitled Motion for Withdrawal of Counsel (ECF No. 676 ) is GRANTED. The Clerk of Court will remove Casey R. Fronk and Michael E. Welsh's names from CM/ECF and the docket such that they no longer receive electronic service of materials filed in this case.
