ORDER GRANTING MOTION FOR INTERLOCUTORY ORDER FOR ACCOUNTING by Judge Stanley Blumenfeld, Jr.: In this action to collect delinquent employer contributions to an employee benefit plan, Plaintiff Construction Laborers Trust Funds for Southern California Administrative Company seeks an interlocutory order for an accounting so that Plaintiff can determine the amount owed by Defendant Base Point General Engineering 20 . Because Defendant's obligation to the plan cannot be determined without an accounting and the governing agreement requires Defendant to submit to an audit, the Court grants Plaintiff's motion. It is ORDERED that within 30 days after service of this order, Defendant Base Point General Engineering shall submit to an audit of its books and records by Plaintiff Construction Laborers Trust Funds for Southern California Administrative Company and shall produce to Plaintiff or Plaintiff's designated agent payroll and business records for the time period from 9/1/2020 to the present. This order shall be effective immediately. Plaintiff shall promptly serve this order on Defendant and on its Chief Executive Officer, Nicholas Hardin, and shall file a proof of service by 5/24/2024. No later than 7/12/2024, Plaintiff shall file either a motion for default judgment or a status report explaining why, despite its diligence, it remains unable to file a motion for default judgment.
