Order on Motion to Amend/Correct
ORDER granting in part and denying in part 75 Motion to Amend/Correct. As discussed at today's conference, Plaintiff's motion for leave to file a fifth amended complaint is GRANTED. The fifth amended complaint (ECF No. 75-1) is now the operative complaint in this action. Plaintiff's accompanying request for leave to issue third-party subpoenas is DENIED for the same reasons that Judge Broderick previously denied Plaintiff's requests for evidence preservation and expedited discovery. See, e.g., ECF No. 74 at 16-19. Plaintiff is directed to serve the fifth amended complaint (ECF No. 75-1) on Defendants by Thursday, July 30, 2026. Service must comply with Rule 4 of the Federal Rules of Civil Procedure. Defendants will have 45 days from the date that service is effectuated to respond to the fifth amended complaint.
