Order on Motion for Local Rule 37.2 Conference
ORDER granting 31 Letter Motion for Local Rule 37.2 Conference: For the reasons stated on the record at the June 25, 2026 conference, and pursuant to Federal Rule of Civil Procedure 37(c)(1)(A), the Court will not preclude Plaintiff's two late-disclosed experts; rather, if Plaintiff wishes to use these experts on summary judgment or at trial, it is hereby ORDERED that Plaintiff shall pay reasonable incurred costs, including attorney's fees, for one lawyer for Defendant to prepare for and take a deposition of each expert that Plaintiff disclosed on May 28, 2026, and intends to offer as evidence. The deadline for expert discovery is EXTENDED solely to allow Defendant to depose these newly disclosed experts and, if Defendant so chooses, prepare rebuttal experts and proffer them for deposition. The parties are further ORDERED to meet and confer and file a letter by July 2, 2026. The letter must advise the Court whether the parties wish to pursue expert discovery now or remain in private mediation, reserving decision on expert discovery. If the parties wish to pursue expert discovery now, the letter must propose an amended expert discovery timeline for Defendant to depose Plaintiff's newly disclosed experts and prepare rebuttal experts if necessary. The parties may also request to continue pursuing private mediation and file a letter proposing dates for expert discovery at a later time. To be clear, nothing in this order should be construed as permitting Plaintiff to continue pursuing expert discovery or to expand the scope of expert discovery available to Defendant. The extension of the expert discovery deadline shall be for Defendant's benefit, only, and tailored to the time needed to meet the evidence offered by the newly-disclosed Plaintiff's experts.
