Order on Motion for Extension of Time
PAPERLESS ORDER denying 275 Claimant Rosa Vega's motion to extend the remaining deadlines in this case by 60 days. Counsel identifies "unforeseen personal and professional circumstances" that prevented him from having an "opportunity to finalize filings and documents necessary to meet the deadlines for completion of fact and expert discovery and the deadline for the filing of all dispositive motions." (ECF No. 275, 1-2.) Counsel's proffer falls far short of establishing the good cause required under Federal Rule of Civil Procedure 16(b)(4) to modify a court-ordered deadline -- in fact, counsel fails to even mention this standard, much less meet it. Furthermore, the Court previously notified the parties that, because of the extraordinary delays already encountered in this case, any further extensions would be unlikely in the absence of "particularly extenuating circumstances." Additionally, an extension of the discovery, expert, and dispositive-motion deadline by 60 days would necessarily result in a concomitant extension of the trial date in this case. And, under Local Rule 7.6, a "continuance of any trial&nbsp.&nbsp.&nbsp.&nbspwill be granted only on exceptional circumstances." Counsel fails to identify any circumstances that meet these standards.
