Court hears arguments of counsel and grants Plaintiff leave to exceed the 10-deposition limit as outlined in Federal Rule of Civil Procedure 30(2)(A)(i). Of the 5 civilian witnesses identified in the parties' Statement of Joint Discovery Dispute (Dkt. 75 ), Plaintiff is permitted to depose any 2 of those 5 witnesses. Plaintiff is also granted leave to depose any of the remaining 3 witnesses, but should Plaintiff choose to do so, Plaintiff shall pay the reasonable costs, including attorney's fees, incurred by the Defendants with respect to the depositions of any of those 3 additional witnesses. These costs will include the cost of Defendants' counsel's travel to and from the place of the deposition, the attorney time in preparing for and attending the depositions, and the cost of a transcript for Defendants' counsel. The Court declines to address the issue of expert depositions at this time, as no experts have been identified by either party. Notwithstanding, the Parties are expected to engage in reasonable discussions regarding expert depositions before involving the Court. (MGC)
