ORDER (Denying Motion for Reconsideration and Leave to Amend) - The Court declines to reconsider its Order denying Plaintiff's Rule 56(d) Motion (ECFNo. 55 ) or its subsequent Order Granting Summary Judgment (ECF No. 60 ). Plaintiff fails to justify the extraordinary remedy of reconsideration, as he does not demonstrate an intervening change in controlling law, new evidence, a clear error of law or the need to prevent manifest injustice. The Court refuses to disturb its Order Denying Plaintiff's Rule 56(d) Motion (ECF No. 55 ) or its Order Granting Summary Judgment to Defendants (ECF No. 60 ) and reaffirms its conclusion that further amendment would not correct the fundamental deficiencies discussed in its Order Granting Summary Judgment (ECF No. 60 ).
