MINUTE ENTRY: A pre-motion conference on the parties' anticipated motions for summary judgment was held before Judge Carol Bagley Amon on June 18, 2024. Appearances - For Plaintiff: Ryan Zachary Gelber and Deborah Colson. For Defendants J.F.K. Advanced Medical P.C. ("JFK Medical") and Dr. Manuel Ceja: Adam Covitt and Adonaid Medina. For Defendant Citimedical: Christopher Daniel. Plaintiff is permitted to supplement their expert report on the issue of causation by July 3, 2024. Upon receipt of Plaintiff's supplemental expert report, Defendants are directed to advise the Court via letter whether they will supplement their own expert discovery and/or depose Plaintiff's expert again. Following the resolution of all supplemental discovery, the parties are to submit a letter informing the Court whether they still intend to proceed with their motions for summary judgment. The Court, however, warned that, if Plaintiff failed t o file a Second Amended Complaint by September 21, 2020, "the Court will enter a judgment dismissing this action with prejudice[.]" (Id. at 20.) Because no Second Amended Complaint has been filed in this case, the Court has dismissed the action with prejudice. Judgment is hereby entered for Defendants. ORDER: In its Order of Dismissal dated August 6, 2020, the Court dismissed this action and granted Plaintiff leave to amend her claims in a Second Amended Complaint. (Docket entry no. 46 at 19.) The Court, however, warned that, if Plaintiff faile d to file a Second Amended Complaint by September 21, 2020, "the Court will enter a judgment dismissing this action with prejudice[.]" (Id. at 20.) Because no Second Amended Complaint has been filed in this case, the Court dismisses the action with prejudice. The Clerk of Court is respectfully directed to enter judgment in favor of Defendants and to close this case.
