AMENDED ORDER DISMISSING CASE with prejudice. On May 12, 2016, the Court dismissed this action without prejudice upon the Parties' 40 Joint Notice of Settlement. (See D.E. 41.) Therein, the Court provided the Parties fourteen (14) days to, inter alia, request that the Dismissal Order be amended to one with prejudice by filing a stipulation of dismissal with prejudice. On May 23, 2016, the Parties filed a 42 Joint Stipulation of Dismissal With Prejudice. Accordingly, it is hereby ORDERED AND ADJUDGED that this case is DISMISSED with prejudice, each party to bear its own attorneys' fees and costs. ORDER DISMISSING CASE. THIS CAUSE is before the Court on the Parties' 40 Joint Notice of Settlement, filed May 12, 2016. Therein, the Parties indicate that they have reached a settlement and will be filing a stipulation for dismissal with prejudice within twenty-one days. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice, all pending motions are DENIED AS MOOT, and this case is now CLOSED. Within twenty-one days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion and a fully-executed Settlement Agreement, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the settlement if filed, and/or to retain jurisdiction over the Agreement.
