Status Report Order
TEXT ORDER: The Rule 16 Initial Conference was held on 4/26/2024, via Teams teleconference. According to the docket, several Defendants have failed to respond in this matter. No later than 5/10/2024, Plaintiffs are directed to file either, (1) a request for Clerks Entry of Default as to Defendants who have failed to file a response, or (2) a detailed status report advising the Court why Plaintiffs do not seek default. A Joint Status Report, representing input from all the parties, shall be filed on or before 6/17/2024 advising the Court as to progress of discovery and the litigation. The schedules and deadlines are as follows: (1) Rule 26 Mandatory Disclosures shall be exchanged by May 24, 2024; (2) All parties shall produce existing sampling data for all sampling locations in Ley Creek, its tributaries, IFG, OU2, the Expanded Territory, and Defendants properties by May 31, 2024; (3) All Parties shall exchange proposed sampling plans and protocols to address the statute of limitations issue as framed by the Second Circuit (the SOL Issue) by July 10, 2024; (4) Parties to file (i) Agreement on sampling plan and protocol or (ii) Motions for an Order to establish scope of discovery for the SOL Issue and corresponding sampling plan and protocol (the SOL Issue Discovery and Sampling Plan) by July 31, 2024; (5) Parties shall file Access Agreements for access as necessary for the SOL Issue Discovery and Sampling Plan by August 15, 2024, unless a later date is approved by the Court; (6) Sampling work shall be completed by November 1, 2024, unless a later date is approved by the Court; (7) Discovery limited to the matters permitted under the SOL Issue Discovery and Sampling Plan shall be completed by May 7, 2025, unless a later date is approved by the Court; (8) The Parties shall disclose experts and exchange expert reports limited to the SOL Issue by June 4, 2025, unless a later date is approved by the Court; (9) The Parties shall complete depositions of disclosed experts on the SOL Issue by August 6, 2025, unless a later date is approved by the Court; (10) The Parties shall file summary judgment motions, if any, limited to the SOL Issue by September 11, 2025, unless a later date is approved by the Court; and (11) Mandatory Mediation shall be completed by 2/28/2025. The deadlines for any motions for joinder or 3rd party actions are stayed and will be determined by the Court at a later date. The decision as to whether to continue with phase two discovery after September of 2025 will be determined by the Court at a later date.
