Schering Settles Medi-Cal Fraud Suit For $21M

Law360, New York (December 17, 2009, 3:24 PM ET) -- Schering-Plough Corp. will pay California $21.3 million to settle allegations that it deliberately inflated the price of generic asthma drug albuterol and others in order to reap millions in pharmacy reimbursements from the state's Medicaid system, California Attorney General Jerry Brown said Thursday.

The settlement stems from three cases filed against Schering-Plough and subsidiary Warrick Pharmaceuticals by the California, Florida and federal governments, consolidated in the U.S. District Court for the District of Massachusetts, that have been individually settled for a collective total of $69 million,...
