Court Preserves Sikorsky Defenses In $79M Overbilling Fight

Law360, New York (July 19, 2012, 10:03 PM ET) -- The U.S. Court of Federal Claims refused to pare Sikorsky Aircraft Corp.'s defenses in a dispute over $79 million in alleged overpayments for aircraft contracts, ruling Wednesday that only a trial could determine whether Sikorksy had resolved the U.S. claims through an earlier oral agreement with the government.

Judge Charles F. Lettow also denied the government's request for summary judgment on Sikorsky's statute of limitations defense, saying questions remained about when the government knew or should have known about the alleged overbilling.
