6th Circ. Kills Ohio Limits On Medicaid Docs' Political Support

Law360, New York (August 06, 2012, 2:04 PM ET) -- The Sixth Circuit on Friday struck down an Ohio law barring doctors who treat Medicaid patients from making campaign contributions to elected officials who prosecute health care fraud, saying the anti-corruption statute takes an ax to free-speech protections when a scalpel would have sufficed.

In declaring the law unconstitutional, the appeals court noted that while Ohio has more than 90,000 Medicaid providers, fewer than 100 were prosecuted for Medicaid fraud in 2009.
