KCI Loses UK Wound-Patent Fight To Smith & Nephew

Law360, New York (July 14, 2009, 12:00 AM ET) -- Medical device maker Kinetic Concepts Inc. has lost its bid to keep patents relating to negative-pressure wound therapy out of U.K.-based rival Smith & Nephew’s hands, following a U.K. court order lifting a preliminary injunction against Smith & Nephew.

The U.K. Court of Appeal on Tuesday lifted an injunction against Smith & Nephew, declaring invalid all 10 patent claims asserted by KCI against Smith & Nephew for a negative-pressure wound therapy patent KCI licensed from Wake Forest University Health Sciences.
