Colgate Sues J&J Over Total Trademark

Law360, New York (August 03, 2009, 4:54 PM ET) -- Oral health care giant Colgate-Palmolive Co. has sued Johnson & Johnson alleging trademark infringement, saying the personal hygiene company is using a name similar to Colgate's Total brand.

Colgate asked the U.S. District Court for the Southern District of New York on Friday to stop Johnson & Johnson and its subsidiary McNeill-PPC from using the Total Care mark on mouthwash and other products, saying the name will cause confusion with and dilute Colgate's Total brand.
