Law360, New York (September 24, 2009, 8:05 PM ET) -- Having vacated a prior final judgment ruling due to a procedural error, a federal judge has again dismissed medical device maker MarcTec LLC's infringement suit against Johnson & Johnson subsidiary Cordis Corp. over stents.
The ruling grants Cordis' motion for summary judgment of non-infringement on the patents, which relate to the inclusion of certain materials in surgical devices, and dismisses the company's counterclaims that MarcTec's patents are invalid.
