Sandoz Admits To Infringing Ortho Tri-Cyclen Patent

Law360, New York (September 28, 2009, 6:42 PM ET) -- Sandoz Inc. has admitted that it infringed the patent for Ortho-McNeil-Janssen Inc.'s popular contraceptive Ortho Tri-Cyclen Lo but continues to dispute the patent's validity.

Judge Stanley R. Chesler of the U.S. District Court for the District of New Jersey granted partial summary judgment Monday to Ortho, affirming a stipulated and proposed order in which Sandoz admitted that its abbreviated new drug application for generic Ortho Tri-Cyclen Lo directly and indirectly infringed several claims in Ortho's patent for the drug.
