Smith & Nephew Not Enjoined In Wound Therapy IP Suit

Law360, New York (November 17, 2009, 5:05 PM ET) -- Citing doubts about the scope and validity of Kinetic Concept Inc.’s wound therapy patents, a federal judge has denied the medical device company's request for a preliminary injunction in its infringement suit against rival Smith & Nephew Inc.

Judge W. Royal Furgeson Jr. of the U.S. District Court for the Western District of Texas on Monday ruled that Kinetic Concept had not sufficiently shown that it will prove Smith & Nephew’s negative pressure wound therapy devices infringe two of the plaintiff's patents.
