Fed. Circ. Finds Boehringer's Mirapex Patent Valid

Law360, New York (January 25, 2010, 6:59 PM ET) -- A federal appeals court has handed a win to German pharmaceutical company Boehringer Ingelheim International GmbH, reversing a 2008 ruling that invalidated a patent related to the company's Parkinson's disease treatment Mirapex for obviousness-type double patenting.

The decision by the the U.S. Court of Appeals for the Federal Circuit on Monday said the lower court had incorrectly concluded that a safe harbor provision is inapplicable in this case, reversing the district court's judgment of invalidity and remanding the case for further proceedings.
