J&J Appeals Invalidity Ruling For Stent Patents

Law360, New York (February 18, 2010, 1:11 PM ET) -- Johnson & Johnson Inc. has appealed a federal court's ruling in favor of plaintiff Boston Scientific Corp. that four of J&J's patents for drug-eluting stents are invalid.

According to the notice of appeal, filed Wednesday in the U.S. District Court for the District of Delaware, J&J will ask the U.S. Court of Appeals for the Federal Circuit to reverse the district court's orders construing J&J's patents and granting BSC summary judgment of invalidity.

Attorneys for the parties could not immediately be reached for comment on Thursday....
