Law360, New York (July 30, 2010, 4:26 PM ET) -- The Senate Appropriations Committee has voted to advance legislation designed to limit pay-for-delay settlements, a rare victory for critics of the practice.
In a vote late Thursday, the Preserve Access to Affordable Generic Drugs Act, S. 369, was included in the appropriations bill reported out of the Senate Appropriations Committee. The measure would block agreements between a drug-patent holder and its generics rival under which the patent holder agrees to pay the generic company in return for a promise to delay market entry.
