Va. Has Standing To Dispute US Health Care Law: Judge

Law360, New York (August 02, 2010, 3:09 PM ET) -- A federal judge on Monday refused to dismiss Virginia's constitutional challenge to President Barack Obama's health care overhaul, ruling that the state has standing to sue the U.S. over a regulation that preempts state law.

Judge Henry E. Hudson of the U.S. District Court for the Eastern District of Virginia rejected the U.S. government's arguments that Virginia lacks legal standing to challenge the law and that the matter won't be ripe for review until the law goes into effect.
