Law360, New York (August 05, 2010, 11:52 AM ET) -- A federal appeals court has upheld a lower court's ruling that Johnson & Johnson unit Cordis Corp.'s Cypher stents do not infringe two patents held by MarcTec LLC.
The U.S. Court of Appeals for the Federal Circuit on Wednesday affirmed the U.S. District Court for the Southern District of Illinois' grant of summary judgment of noninfringement to Cordis, finding that heat bonding, a key aspect of MarcTec's asserted patents, is not used to make the Cypher stents.
