Law360, New York (October 04, 2010, 6:57 PM ET) -- A federal judge has reversed a U.S. Patent and Trademark Office decision to invalidate Streck Inc.'s patents covering hematology control products, handing the company victory in its long-running patent infringement battle against Research & Diagnostic Systems Inc.
Judge Joseph F. Bataillon of the U.S. District Court for the District of Nebraska on Thursday vacated a 2009 ruling by the USPTO's Board of Patent Appeals and Interferences that concluded that R&D, which Streck had sued for infringement, invented the technology first.
