Genzyme Sues Lupin Over Generic Welchol

Law360, New York (November 03, 2010, 8:08 PM ET) -- Genzyme Corp. and Daiichi Sankyo Inc. have filed suit against Lupin Ltd. in an effort to block it from marketing a generic version of their cholesterol drug Welchol.

The suit, filed Monday in the U.S. District Court for the District of Delaware, claims that Lupin's proposed generic version would infringe two patents on Welchol.

According to the suit, Daiichi Sankyo was issued an approved new drug application for Welchol in October 2009. The drug is used to treat primary hyperlipidemia and type 2 diabetes mellitus, according...
