Law360, New York (December 13, 2010, 1:49 PM ET) -- The U.S. Supreme Court has agreed to hear three appeals to determine whether its landmark decision in Wyeth v. Levine, which held that federal regulations do not shield brand-name drugmakers from state law claims, applies to generic-drug makers.
In three consolidated appeals granted certiorari on Friday, Pliva Inc. and Actavis Inc. will argue that different labeling rules for generics made it impossible for them to change labels to reflect new information on health risks.
