Law360, New York (February 15, 2011, 1:27 PM ET) -- Genetic laboratory PIC USA Inc. has lost out on its renewed bid for claim construction in Genetic Technologies Ltd.'s suit accusing it of infringing a patent for noncoding DNA technologies.
Judge Barbara B. Crabb denied PIC's motion for reconsideration in the U.S. District Court for the Western District of Wisconsin on Monday, once again shutting down the company's effort to define several terms in Genetic Technologies' U.S. Patent Number 5,612,179 before PIC makes a push for summary judgment.
