E.U. Eyes Six-Month Marketing Exclusivity For Pediatric Testing

Law360, New York (September 29, 2004, 12:00 AM ET) -- The European Commission has proposed legislation to encourage pharmaceutical companies to develop more pediatric drugs in return for extended patent rights.

Advanced by the European Union’s Consumer Affairs Commissioner Olli Rehn, the bill closely mirrors the six-month extension of exclusive marketing rights granted to U.S. pharmaceutical companies for pediatric research.

The proposal, put forth on Wednesday, will require new drugs to be tested specifically on children before they are cleared for pediatric use, and aims to stimulate new research into existing medicines.
