Watson Wins Invalidity Ruling On 2 Fentora Patents

Law360, New York (March 11, 2011, 8:07 PM ET) -- A federal judge in Delaware sided with Watson Pharmaceuticals Inc. on Friday in a lawsuit Cephalon Inc. lodged over its efforts to market a generic version of the painkiller Fentora, finding two of three asserted patents for the drug were invalid.

Judge Sue L. Robinson of the U.S. District Court for the District of Delaware said in her order that Cephalon had failed to prove Watson infringed the asserted claims of U.S. Patent Numbers 6,200,604 and 6,974,590, and that the defendant had proven the patent claims...
